1. These terms
These terms apply to every order placed with Aero Sporty Ltd through aerosporty.co.uk. Please read them before you order. By placing an order you agree to them. We may update them; the version in force is the one published when you place your order.
These terms are written for consumers. If you are buying in the course of a business, sections 9 and 10 apply differently and your statutory consumer rights do not apply. Contact us for trade terms.
2. How a contract is formed
Placing an order is an offer to buy. Our acknowledgement email confirms we have received it, but it is not acceptance. A contract exists only when we email to confirm the item has been dispatched. If we cannot accept your order, for example an item is out of stock, priced incorrectly, or we cannot deliver to your address, we will tell you and refund any payment in full.
3. Pricing and errors
Prices are in pounds sterling. Delivery is charged separately and shown at checkout before you pay.
We take care with pricing, but errors happen. Where the correct price is higher than the price shown, we will contact you before dispatch and you may confirm the order at the correct price or cancel for a full refund. Where a pricing error is obvious and could reasonably have been recognised as a mistake, we are not obliged to supply at the wrong price.
4. Payment
We accept payment by Revolut or UK bank transfer, selected at checkout. Both are manual: no payment is taken automatically when you place the order, and no card or account details are entered on this website. We email you the payment details for your chosen method together with your order reference, and the order is confirmed once the payment clears. Goods remain our property until paid for in full.
5. Product information
We describe products as accurately as we can, using manufacturer specifications. Images are illustrative; colours vary between screens and manufacturers change specifications without notice. Figures such as suction power, runtime, coverage area and heat output are quoted by manufacturers from test conditions and will differ in real use depending on the space, surface, climate and how the product is used. Packaging may differ from that shown.
6. Delivery
Delivery costs and timescales are set out in our delivery and shipping policy, which forms part of these terms. Risk in the goods passes to you on delivery.
7. Cancellation and returns
You have a statutory 14-day right to cancel, and we offer an extended 30-day returns window. Full details, including who pays return postage and how refunds are calculated, are in ourreturns and refunds policy, which forms part of these terms.
8. Safe installation and use
It is your responsibility to install and use products safely, lawfully and in line with the manufacturer's instructions. In particular:
- hard-wired electrical products, underfloor heating systems and gas or propane appliances (including water heaters, patio heaters and gas fire pits) must be installed by a suitably qualified person where the manufacturer or UK regulations require it;
- hot tubs and swim spas must stand on a base able to take their filled weight, with a suitable electrical supply protected by an RCD;
- fire pits, outdoor fireplaces and barbecues must only be used outdoors, at a safe distance from buildings, fences and overhanging trees, and never left unattended while lit;
- lawn mowers and robot mowers must be operated with children and pets kept clear of the working area.
We supply products for lawful use only, and accept no liability arising from use that breaks the law or the manufacturer's instructions.
9. Our liability to you
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, or for breach of your legal rights in relation to the goods.
We are not liable for business losses. If you use the products for any commercial or resale purpose, we have no liability for loss of profit, loss of business, business interruption or loss of business opportunity.
10. Events outside our control
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier failures, extreme weather, industrial action, or supply chain disruption. We will contact you as soon as possible and you may cancel affected orders for a full refund.
11. Website use and intellectual property
The content of this site (text, layout, graphics and code) belongs to us or our licensors. You may view and print pages for your own use, but not reproduce them commercially without permission. Product names, brand names and logos are the property of their respective owners and are used for identification only.
You may not misuse this site by knowingly introducing malicious code, attempting unauthorised access, or placing fraudulent orders.
12. Complaints
Email info@aerosporty.co.uk or call +44 7551 570516. We acknowledge complaints within 3 working days and aim to resolve them within 14.
13. Governing law
These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.
